CarbonEnfo, Inc. (“CarbonEnfo,” “we,” “us,” or “our”) values your privacy. This Privacy Policy explains how we collect, use, share, and protect your personal information when you use the Brytr platform, located at https://brytr.us (the “Platform”), and related software, services, and technologies (collectively, the “Brytr Services” or the “Services”). By using the Brytr Services, you agree to this Privacy Policy. If you do not agree, please do not use the Brytr Services.


1. Information We Collect

We collect information from and about you in several ways, including:

1.1 Information You Provide Directly:

  • Account Information: When you create a Brytr User Account, we collect information such as your name, email address, phone number, payment details, and other information required to set up and verify your account.
  • KYC Verification: We may collect additional information to comply with know-your-customer (“KYC”) and anti-money laundering regulations, such as identification documents or government-issued IDs.
  • Transaction Data: We collect details about transactions conducted via the Platform, including information about Solar Renewable Energy Credits (“SRECs”), SREC Tokens, and payment details.


1.2 Information Collected Automatically:

  • Device and Usage Data: We collect technical information about your device and how you interact with the Platform, including IP address, browser type, operating system, and usage patterns.
  • Blockchain Data: When you use the Platform, we may collect publicly available blockchain data, such as wallet addresses, transaction records, and digital asset balances.


1.3 Information from Third Parties:

  • Installer-Provided Data: If you authorize your solar installer (“Installer”) as described in the Brytr Platorm Agreement , we may receive personal information and related data directly from you Installer, including your name, contact details, solar array details, inverter identification numbers (“IDs”), solar energy generation data, and API credentials or other technical access rights necessary to provide Brytr Services.
  • Energy Data: We also collect solar energy production and related data through third-party software or hardware providers, including access to associated Application Programming Interfaces (“APIs”).
  • Third-Party Services: We may receive information about you from other services you link to the Brytr Platform, such as non-custodial wallets or external payment providers.


2. How We Use Your Information

We use your information to provide, maintain, and improve the Brytr Services, including:

  • Providing Services: To process transactions, create SREC Tokens, and facilitate the listing and sale or exchange of SREC Tokens on the Platform.
  • Compliance: To comply with legal obligations, including KYC, anti-money laundering, and tax reporting requirements.
  • Installer-Provided Information: We use personal information and data provided by your Installer to verify solar array and inverter ownership, tokenize and track solar renewable energy generation, create SRECs and SREC Tokens, and to facilitate and support your participation in the Brytr Services.
  • Enhancing User Experience: To analyze user behavior and improve the Platform’s functionality, security, and user interface.
  • Communication: To send transactional or promotional communications, respond to inquiries, and provide updates about the Platform.
  • Fraud Prevention: To monitor and prevent fraudulent or unauthorized activity on the Platform.
  • Legal Obligations: To enforce our terms of use, resolve disputes, and respond to legal requests.


3. How We Share Your Information

We do not sell your personal information. However, we may share your information as follows:

3.1 With Service Providers: We may share information with vendors, consultants, and other service providers who need access to your data to perform services on our behalf, such as KYC verification, payment processing, or platform hosting.

3.2 With Blockchain Networks: Transactions conducted via the Brytr Platform involve the use of blockchain networks. Certain information (e.g., wallet addresses, transaction details) will be publicly available and permanently stored on the blockchain.

3.3 For Legal and Compliance Purposes: We may share information:

  • To comply with applicable laws, regulations, or legal processes.
  • To respond to lawful requests from public or regulatory authorities.
  • To enforce our terms, protect our rights, or prevent harm.

3.4 With Affiliates and Partners: We may share your information with our affiliates or business partners for purposes consistent with this Privacy Policy.

3.5 During Business Transactions: In the event of a merger, acquisition, or sale of assets, your information may be transferred to the acquiring entity.

3.6 With Your Installer: We may share your personal and energy generation data with your Installer for purposes including verifying provided information, managing discrepancies, enhancing service delivery, troubleshooting, or otherwise supporting your participation in the Brytr Services.


4. Your Rights and Choices

4.1 Access and Correction: You may access or update your account information by logging into your User Account. For additional assistance, contact us at support@brytr.us.

4.2 Opt-Out: You may opt out of receiving promotional communications by following the unsubscribe instructions in those messages or contacting us. Note that you may still receive transactional or service-related communications.

4.3 Data Portability: Subject to applicable law, you may have the right to request a copy of the personal data we have collected about you in a structured, commonly used, and machine-readable format.

4.4 Deletion: You may request that we delete your personal data. However, certain information may be retained to comply with legal obligations, resolve disputes, or enforce our agreements.

4.5 Rights Regarding Installer-Provided Information: If your Installer has provided personal or technical data to CarbonEnfo under your authorization, you may access, review, or request corrections to such information by contacting us directly at support@brytr.us.


5. Security

We use administrative, technical, and physical safeguards to protect your information. However, no system can guarantee absolute security. You are responsible for keeping your account credentials and blockchain wallet information secure. We also require your Installer and any third-party providers sharing data with us under your authorization to implement reasonable security measures to safeguard your information.


6. Data Retention

We retain your information as long as necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required by law. Blockchain transaction data cannot be altered or deleted once it is written to the blockchain.


7. International Data Transfers

If you are located outside the United States, your information may be transferred to and processed in the United States or other countries where we or our service providers operate. By using the Brytr Services, you consent to such transfers.


8. Third-Party Links

The Brytr Platform may contain links to third-party websites or services. We are not responsible for the privacy practices of these third parties. Please review their privacy policies before providing them with your information.


9. Children’s Privacy

The Brytr Services are not intended for individuals under the age of 18. We do not knowingly collect personal information from children. If you believe we have collected information from a child, please contact us.


10. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If we make significant changes, we will notify you by posting the revised policy on this page and updating the “Effective” date. Your continued use of the Brytr Services after such changes constitutes your acceptance of the updated policy.
